Typical Legal Practice Areas of a Queensland Regional Law Firm ...

Following on from the previous article, the second set of most commonly provided areas of law within a solicitor?s office will be described here. Covered in the first article were business and agricultural structures and arrangements, family and relationship law and not for profit. Leading law firms also offer services in the areas of property and conveyancing. This subject is regarding acting for people when buying or selling land and residential or commercial property. Many people do not understand the wide number of processes that are required in this area. Your lawyers may review a contract, keep a record of key dates, check on your financial requirements, help with transfer duty and the payment of this, organise and attend the settlement, advise council on the change of ownership, and liaise with your bank.

Commercial and Property Law
Commercial and Property Law typically involves acting for people when they are developing property, or purchasing or selling rural property, industrial or commercial enterprises. Many of the processes are the same as for Property and Conveyancing, but may also include leasing, business structuring, planning law, guarantees and loan documentation, information on consolidations or subdivisions and advice on rates, land tax, ST and other taxes.

Environmental and Development Law
This area of law may be needed if there are any issues regarding the use of the environment or the impact of building or running a business on the environment. Lawyers can help their clients in the Planning and Environment Court and represent clients faced with environmental protection orders. Included in this area is also Local Government Laws. Lawyers can act for the local government in interpretation of local laws, and provide advice on civil litigation claims and freedom of information issues. For private clients, the firm can offer advice on government legislation, and local law and planning.

Native Title
Due to decisions in the High Court during the 1990s, there may now be Native Title over land that rural and mining clients will need advice on. With many grazing and term leases now coming due for renewal over Queensland, this is becoming a larger part of a law firm?s service provided to rural clients.

Tax Effective Estate Planning and Testamentary Trusts
Every family and financial situation is different from another. A lawyer working within this area of law will act for people in areas related to planning for their future and the future of their family. Lawyers will need to gain a well-rounded picture of what each of these families hopes regarding these are. Services in this area would include wills, powers of attorney, health directives, trusts, succession planning, estate disputes and administration and superannuation nomination. And this may also include rural and business estate planning.

Commercial Litigation
Commercial litigation means acting for people in business who have disputes. This may be an individual, a contractor, shareholder, executor or company. Services provided in this area may be litigation or dispute resolution for building, construction, wills, trusts, contracts, debt collection, workplace relations, bankruptcy or corporate issues.

Mobile World Congress: Best of day one

The year's largest display of up-and-coming mobile phones, Mobile World Congress, has gotten off to a good start ? especially for Android. Check out a list of our favorites from day one of the conference.

Mobile World Congress, one of the largest gatherings of phone makers, is always full of good surprises. And this year?s show is no exception. Already during the first day of the conference in Barcelona, big-time manufacturers from Sony to Samsung have showcased new Android phones aplenty ? one of which actually has a built-in projector. Here are three of the most appealing phones from the show so far.

Samsung Galaxy Beam

Just as the name suggests, Samsung?s latest Android phone serves as a mini-projector, displaying ?anything on its screen in 640 by 360-pixel resolution. (We?re already imagining life-size Temple Run projected onto a wall.) The Galaxy Beam is a littler thinker than a normal phone, but remains less than half an inch thick. Samsung says the phone can project for about three hours straight on a single charge, and judging by CNET photos, projections are bright and clear. Initially, the idea of a projector brings back memories of elementary school science class ? but in reality, it?s one of the great untapped technologies of mobile phones. If it delivers, the Beam will be able to cut out the many cords and frustrations that come with linking up computers/phones to televisions and other screens. Good for business presentations, great for playing games and video.

HTC One X

This is the Incredible Hulk of Mobile World Congress so far. It?ll have a Tegra 3 quad-core 1.5 GHz processor, for extra zippy speeds. But don?t get too excited. The American version of the One X swaps out the quad-core for a SnapDragon S4, but throws in a 4G LTE antenna for a faster Internet connection. Both editions come with a ton of attractive features ? a 4.7-inch, 1280 by 720 HD screen and a camera capable of shooting a photo every 0.7 seconds. It also runs on the latest Android 4.0 Ice Cream Sandwich. Plus, it?s pretty sleek.

HTC also announced the HTC One V, a decidedly less enchanting phone than the X, but it?ll probably be more affordable. The One V has a 3.7-inch, 800 by 480 pixel screen and runs on Android 4.0. We?d equate it to the iPhone 4 ? not quite the 4S, but still good.

Sony Xperia U

Hey, it?s definitely not the next powerhouse phone. But it?s not pretending to be, either. Sony?s Xperia U is one of the latest smart phones that?s aiming for an audience unwilling to shell out a ton of cash. Its 3.5-inch screen makes it easy to hold, and its 5-megapixel camera is less than, say, an iPhone 4S 8-megapixel camera, but that comes with the territory. Still, it looks like the Xperia U has some cool music features, such as surround sound and wireless streaming to speakers. Now, that?s a perk.

As MWC continues, we?ve still got a few hopefuls to look out for ? Windows 8 phones, please! ? but progress is steady thus far. Some phones will join a long list of others in anonymity (who remembers the HTC ChaCha last year?), but we?re hoping at least a few will go the distance.

Churchyard Stories: The Siblings Of Barnsley | The Cotswold History ...

There are a couple of gravestones in the churchyard of St Mary?s in Barnsley that share an unhappy similarity; they mark the death of two siblings at similar ages to each other, but in different years.

One remembers Louisa and Charles Poole. They were the children of Barnsley plasterer Robert and his wife Sarah, who seem to have lived next door to the public house in the village.

They had had at least nine children between 1847 and 1866, the last being born when Sarah was in her 40s. Louisa was the eldest.

The couple?s first son, born two years after Louisa, was William. He was the family?s first tragedy, dying some time in the late 1850s, and not reaching 10 years old. Charles, the Poole family?s third child, then became the eldest son and brother to the subsequent children ? Jane, Maria, another William, Samuel, Robert, and James.

Third daughter Maria also seems to have died a couple of years after her brother William, dying in either 1862 or 1863, when she was around six years old.

The Pooles then seem to have enjoyed a few years of calm before calamity struck again. Eldest daughter Louisa died in 1867, aged 20; then son Charles died seven years later, aged 22. Both died in the same month ? July.

So out of the Pooles? five eldest children, four died early; sad, but unfortunately not a rarity in 19th century England.

The second grave shows that even if one successfully negotiated the travails of infancy and childhood, one was not safe from the numerous illnesses and diseases that could strike people at will in Victorian Gloucestershire.

This grave commemorates two brothers who died at the same age. They were two of the children of road labourer, and former agricultural labourer, Abel Morse and his wife Mary Jane. They were another large family; they married in 1853, and were soon parents to James, Eliza, Dinah, Mary Jane, Albert, and Thomas. These were the children who survived infancy; it looks like they also lost other children young.

In 1881, Abel was 60, Mary Jane 49. They had three children still living at home ? James, 26, an agricultural labouer; and the younger children Mary, 12, and Albert, 6, both still at school.

But three years after the census was taken, James died, in his thirtieth year. His death was shortly before Hallowe?en, on 28th October 1884. His gravestone is engraved with the inscription, ?One step between me and death?.

In 1891, Abel and Mary Jane had their last two adult children at home with them ? Thomas, 28, a general labourer, and 22-year-old servant Mary, who was known as Polly. Two years later, though, on 8 May 1892, Thomas died, aged 30. He was buried in the same plot as his older brother James ? ?absent from the body, but present with the Lord?.

Mary Jane Morse died in 1897, aged 60, but her husband Abel didn?t die until 1908, decades after the deaths of his two beloved sons.

It's been a few months since we last heard about the legal kerfuffle between Sky and pub owner Karen Murphy. In case you've been out of the loop, it all started when the UK broadcasting giant went after Murphy for using what was deemed to be an illegal method for screening FA Premier League matches at her, or any, bar. The Greece Nova decoder, which is considered a legal bit in the privacy of your own home, was helping Murphy bypass Sky's £480 ($740) required monthly fees for bar owners and saving her over £350 ($555) in the process. Now, over $260,000 in legal fees later, Mrs. Murphy's conviction has been overturned by the relentless High Court. The ruling allows her to keep using the troubled Greek gadget to screen any EPL game without facing any troubles -- except the occasional drunken fracas. So, now you know where to go the next time you're in Portsmouth and want to catch a good ol' footy match.

The fact of the matter is that the typical ?luxurious? Hawaiian resort is expensive?really expensive. The good news is that you don?t have to stay in one of these overrated resorts, and certainly not for your whole vacation. In fact, your other options are not only more affordable, but likely more romantic, intimate, and customizable. Your best option is to take advantage of apartment-style accommodations, like condominium-style hotels, vacation rentals, and timeshares. You?ll likely be able to find a perfectly suitable room or apartment in a great location for a fraction of the price. Home Away, for instance, has cottage rentals in Hawaii for as low as $79/night. Many of the vacation rental apartments in Hawaii also offer weekly rates, like Polynesian Plaza, where you can stay a whole week for $505 (just call in advance to request a king-size bed). Plus, you?ll save additional money by being able to cook your own food and do your own laundry.? If you want all the services offered by a hotel (apartment-style accommodations don?t include maid service, room service, etc.), look into one of the many quaint bed and breakfast inns scattered around the islands. If you absolutely must stay in a resort, refrain from reserving the ?ultimate-presidential-first-class-honeymoon suite.? A regular suite will be more than good enough!

On any vacation, the cost of food tends to sneakily add up until you?ve dished out hundreds of dollars on (often mediocre) dishes. You can make sure this does not happen if you are aware of all your choices. The word ?buffet? sounds affordable enough, right? Think again! The typical resort buffets in Hawaii tend to cost upwards of $25 per person!? We strongly suggest you stay away from these. The cheapest way to eat, of course, is to go grocery shopping and cook some of your own meals and snacks in one of those apartment rentals we talked about. (Even many of the resort guest rooms include kitchenettes). Of course, we?re not saying you shouldn?t enjoy some of the delicious and fresh Hawaiian cuisine. But look for coupons in brochures and online at sites like DailyDealsHawaii.com.

4. Car Rental

Renting a car is almost a necessity for a honeymoon in Hawaii. The islands are big and diverse, and the public transportation system is lacking in many places. To get the best deal on a car rental, book weeks in advance, and preferably through the airport as they often have better discounts?you can expect to spend between $30 and $50 per day. Rent a small, practical car for a cheaper rental and less money wasted on gas. It may be tempting to rent a jeep or convertible, but it?s really not necessary or worth it. Also remember that you may not need a car for every day of your vacation. For example, if you?re spending the day at the beach down the street from your lodgings, your rental car will sit around unused for an entire day. Finally, avoid the offers for valet parking! Sometimes it can be tough to find a parking spot in places like Honolulu, but paying for valet parking is very expensive in Hawaii?usually $26 and upwards.

5. Sightseeing & Fun in the Sun

One of the best things about Hawaii is that one of the main attractions is absolutely free. Of course, we?re talking about the world-famous pristine beaches.? However, Hawaii has so much to offer that you probably won?t want to spend all your time on the beach. After all, you won?t want to miss out on taking tropical jungle excursions, hiking the infamous Diamond Head crater, honoring history at Pearl Harbor or hula dancing at a traditional Hawaiian luau. Fortunately, it?s easy to find discounts on these kinds of attractions through travel discount websites like Smart Destinations, where you can get free admission to over 30 attractions with the purchase of one pass. Typical savings are up to 55% over regular gate prices.

?Everyday life seems unbelievably minuscule when faced with the prospects of death and dying.? These are the words of Dr. David Avery. David is thirty years old, unmarried, a successful doctor, and has recently been confronted with the knowledge that he is suffering from a terminal form of acute leukemia. NEW YORK (AP) ? With the blessing of Maurice Sendak, Stephen Colbert is releasing a children's book.

Grand Central Publishing said Tuesday that it will publish "I Am a Pole (And So Can You!)" on May 8. In a two-part "Colbert Report" segment that aired last month, Colbert previewed the book with "Where the Wild Things Are" author Sendak.

Claiming he was looking to "cash-in" on celebrity children's books, Colbert penned an illustrated story about a flag pole's quest for identity.

Sendak called the book "terribly ordinary" but acknowledged, "The sad thing is I like it."

In a statement, Colbert said: "I hope the minutes you and your loved ones spend reading it are as fulfilling as the minutes I spent writing it."

Grand Central previously published Colbert's 2007 bestseller "I Am America (And So Can You!)" It will also publish his next book, "America Again: Re-Becoming the Greatness We Never Weren't" in October.

After a two-episode hiatus due to his ailing mother, Colbert returned to "The Report" on Monday.

This is a classic little salad, one of the basics you?ll often find served at falafel stands and lunchtime restaurants. It?s a pleasant, simple creation with a sharp, fiery tang from lemon juice and raw garlic, along with a slight bitterness from the lemon peels.

You can make it by grating up some whole carrots, or, say, using the carrot cores left over from my stuffed carrot recipe. As a bonus, if you happen to use brightly colored carrots, then you?ll get a salad with a riot of color, which I guarantee you?ll never see at your neighborhood falafel shop.

These colored carrots can be purchased at the various farmer?s markets as well as at a few shops in Jaffa (and sometimes Ramle).

My version uses so-called Chinese lemons ? those miniature fruits also known as limequats ? which have particularly thin skins that lack the bitterness of their pithier, full-sized cousins.

For about two cups? worth:

  • 2 cups finely chopped carrot
  • 1 garlic clove, crushed
  • 2 mini lemons (?Chinese lemons? in Hebrew, also known as limequats in English), finely chopped, seeds removed (alternately: 1 tablespoon lemon juice plus 2 tablespoons lemon pulp and zest)
  • 1/2 teaspoon salt
  • 2 tablespoons olive oil
  • 1/4 cup parsley, chopped

Prep time: 5 minutes.

Mix together all the ingredients. Let sit for about 15 minutes so the flavors can blend.

Regarding the lemon: Chinese lemons are sweet enough that you can use them whole, but larger, traditional lemons have a bitter pith. After squeezing them for juice, you?ll want to remove some of the zesty yellow outside with a vegetable peeler (it?s OK if you get some of the white pith) and chop up that along with the pulpy inside to get the 2 tablespoons called for in the recipe.

Online games, technology news and reviews | ? Video games ...

The Interactive Games & Entertainment Association (iGEA), New Zealand?s interactive games industry body, with its independent market research group NPD, are pleased to announce that its retail measurement has captured close to 100 per cent of New Zealand?s computer and video game retail data for the first time.

The latest data from NPD Group, which includes all revenue generated from console hardware, games software and gaming peripherals sold through retail indicates a staggering $179.6 million generated in the 2011 period.

However, this data excludes sales from online retail, downloadable content, online games subscriptions, in-game micro-transactions and mobile games. iGEA?s New Zealand Director Mark Goodacre says the growing popularity of digital games isn?t telling in the latest results.

?As people increasingly consume interactive entertainment through mobile devices and online, it?s becoming more difficult to collect sales data through a single source. Looking at the latest Digital New Zealand[i] report, we see that Kiwi gamers are almost buying equally through online stores and local retailers,? said Goodacre.

Digital New Zealand found 24 per cent of Kiwi gamers buy games new from a download store and 14 per cent buy boxed games new from an online store, with 37 per cent buying purchased box games from a local retailer.

PriceWaterHouseCooper?s[ii] latest report echoes the growing trend towards digital games with revenue for online games expected to increase by 12.5 per cent to $13 million in 2015 and mobile games predicted to rise by 10.5 per cent to $99 million in the same period.

Mark Goodcare commented, ?There is a lot of research pointing towards a buoyant interactive games industry. The global success of games such as Call of Duty 3: Modern Warfare 3 which became the fastest entertainment property to hit the $1 billion milestone globally, eclipsing the previous record set in 2009 by the film Avatar, is just one example of this.?

Stephen Knightly, Chairperson of NZ Game Developers Association, says the growth of digitally distributed games is an export opportunity for New Zealand businesses.

?New Zealand is already a net exporter of digital games. Local game studios selling our games over the internet and smartphone App stores earn more than Kiwi gamers spend playing digital and online games.?

?Online, social and mobile games have been the fastest growing parts of the games industry in recent years and they?re also the kinds of games that Kiwis are good at making.?

Key statistics from NPD Group Australia:

  • The top 20 software sales featured shooter games, role playing games, Rugby games, sports games, Timecards and Points cards as well as Dance games.
  • The most popular genre are shooter and action (both at 19 per cent) followed by family games (10 per cent) and racing (10%)

NPD data in 2011 was measured against 52 weeks compared to 52 weeks in 2010.

a>p>Hurrying through their copy, writers and speakers sometimes make really fundamental mistakes. Occasionally these errors are caused by a habit formed years ago, when the person starting using a word or phrase incorrectly. With no editor or other expert source to correct them, they continue making the same mistake. The difference nowadays is that such a mistake in a professional environment can have dire consequences. In this article, I review some terms and words that are commonly misused.

This list is by no means complete. You may have other challenges. Make sure you are constantly reviewing your material, looking for common and not-so-common errors. Good writing takes time, so be patient. You will be rewarded with much better copy in the end.

1. Hopefully ?

An adverb, hopefully must accompany a verb. It is used to describe a state of being or feeling. When used with the verb to wait, for example, it indicates a sense of patience or anxiousness.

He waited hopefully for her flight to arrive.

Use hope with a subject to create the sentence you intended.

We hope the store will open soon.

I hope to finish the project on time.

She hopes she won?t have to file another application.

2. Irregardless and Regardless -

Irregardless is one of those non-existent words that pops up in usage from time to time. The less in regardless indicates a negating action. The proper word is regardless.

The project will be finished regardless of cost.

You may find it helpful to use the word whether in your sentence.

Regardless of whether we renew their contract?.

The team approach works best regardless of whether?.

3. I.E. vs. E.G. -

Writers tend to confuse these two, using i.e. when they really mean e.g.

I.e., an abbreviation for id est, means that is, and is used to clarify a point.

E.g., exempli gratia, means for example, and usually is what the writer intends.
